Tyler Stated:
...I don't know that just because something has a certain brand on it that the actual manufacturer cannot be held ultimately responsible for defects.
You are free to sue anyone you wish, how it plays out would be the question. Consider...
A bag of Silicon is mislabeled as Quartz by Caldera Minerals in Brazil
It is shipped to China and fired into spark plug ceramic bodies with the Rotax Brand on it.
The Ceramic bodies are Shipped to NGK in Japan and assembled into spark plugs and boxed with the Rotax brand on it.
The Finished plugs are shipped to Austria where Rotax certifies the plugs as good.
Three years later a number of plugs fail because of ceramic body cracks. and it is determined that the ceramic is of the wrong composition.
Were lies the FAULT? ... Caldera Minerals. Where lies the RESPONSIBILITY? ... Rotax.
What would be the resolution ...
Rotax would issue an Advisory Bulletin telling all owners that they will need to immediately Purchase replacement plugs due to the defect.
If you would expect that there would be a Global Recall and Free Replacements ...
Go ask the folks that have already purchased Redesigned Carb Floats for the third time!
Who holds the Responsibility in this situation.
The Pilot that didn't check the floats before the flight?
The Installer who didn't insure the Floats were good?
Rotax, who marketed the Floats'?
Bing, who supplied the Floats?
The Company that Manufactured the Floats?
The Company that Supplied the Plastic for the floats?
Where does the finger-pointing end?
